Terms of Use & Lab Report Access Agreement

1. Acceptance of Terms

This website and the services offered on it (the "Service") are owned and operated by Talent Testing Service ("TTS") and I Know My Status ("IKMS") (collectively, "TTS/IKMS"). The Service is provided to you, and your authorized representatives, pursuant to the terms and conditions of this Terms of Use, the Lab Report Access Agreement contained herein, and any operating rules or policies published by TTS/IKMS (including the Privacy Policy), as may be amended from time to time (collectively, the "Agreement"). BY USING THE SERVICE OR ACCESSING ANY LAB REPORTS THROUGH TTS/IKMS, YOU AND ALL AUTHORIZED REPRESENTATIVES ARE INDICATING YOUR AGREEMENT TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS CONTAINED IN THIS AGREEMENT.

2. User Responsibilities

By consenting to this Agreement, you agree:

2.1  To accurately represent only yourself on the Service. The Service may only be used by natural persons on their own behalf and not by or on behalf of any commercial entity unless explicitly permitted by TTS/IKMS.

2.2  To provide accurate information to TTS/IKMS and other users of the Service, including information required to register and information posted in public areas of the Service.

2.3  To provide for your own access to the Service, including obtaining and maintaining all hardware, software, and internet access, and paying all related charges.

2.4  Not to use the Service to:

A. Publish or distribute any false, inaccurate, defamatory, infringing, obscene, or unlawful material or information;
B. Defame, abuse, harass, threaten, stalk, or otherwise violate the legal rights of others;
C. Send unsolicited email or collect or store personal data about other users;
D. Promote or provide instructional information about illegal activities or promote physical harm against any group or individual;
E. Upload files containing viruses, corrupted files, or software that may damage another's computer;
F. Upload files containing material protected by intellectual property laws unless you own or control the rights thereto;
G. Delete or modify author attributions, legal notices, or proprietary labels in any uploaded file;
H. Post any franchise, pyramid scheme, or other unauthorized business opportunities;
I. Download any file you know cannot be legally distributed via the Service; or
J. Reproduce, duplicate, copy, sell, resell, distribute, or exploit for any commercial purpose the software, products, or services provided by TTS/IKMS without prior written consent.

2.5  To acknowledge that it is your responsibility to seek follow up care, treatment, and ongoing medical management from your own healthcare provider for any medical conditions or test results identified through the Service. Treatment for eligible positive results is available for those who tested in a TTS/IKMS office location. This would be at our clinician's discretion, in accordance with current CDC guidelines, and does not replace ongoing care from your personal healthcare provider. Treatment is not available for those who visit an Associated Draw Facility.

2.6  To agree that you will not initiate a credit card chargeback for any service or membership fee. If a chargeback is initiated, TTS/IKMS reserves the right to immediately suspend or permanently terminate your access to the Service, including all testing, membership benefits, and future ordering privileges.

2.7  That you are at least 18 years of age, and that by using the Service, you represent and warrant that you meet this age requirement. TTS/IKMS reserves the right to terminate access if it reasonably believes a user does not meet this requirement.

2.8  That you are responsible for maintaining the confidentiality of your login credentials.

3. Lab Report Access — Producers and Agents

The following terms apply to any producer, agent, or other industry representative who accesses talent lab reports through TTS/IKMS. By accessing lab reports, you agree to each of the following:

  • Confidentiality: Lab reports and related health information are confidential and sensitive. You may only access a talent's results when the talent has authorized such access.
  • Limited Use: You may use lab reports solely for legitimate industry-related health and safety purposes. You may not use this information for harassment, discrimination, intimidation, exploitation, or any unrelated purpose.
  • No Posting or Public Sharing: You will not post, upload, publish, or distribute any portion of a talent's lab report or health information, including on social media, websites, forums, or any public platform.
  • No Unnecessary Sharing: You will not share lab reports with individuals or entities except as reasonably necessary for legitimate industry-related business purposes.
  • No Alteration or Misrepresentation: You will not alter, falsify, or manipulate any lab report, nor misrepresent a talent's clearance status or identity.
  • Security Responsibilities: You are responsible for maintaining the confidentiality of your login credentials and preventing unauthorized access to reports obtained through your account.
  • Breach Notification: You agree to notify TTS/IKMS promptly (no later than 48 hours), upon becoming aware of any unauthorized access to, or disclosure of, lab reports or login credentials associated with your account.
  • Data Retention and Destruction: You agree to securely delete or destroy any lab reports or health information obtained through TTS/IKMS once they are no longer needed for the authorized business purpose for which they were accessed. If a talent's authorization is revoked or expires, you agree to immediately cease all use of and destroy any lab reports obtained under that authorization.
  • Talent Authorization: Access to lab reports is based upon authorization provided by the talent. Once information is disclosed pursuant to that authorization, TTS/IKMS cannot guarantee how third parties will use or further disclose the information. You acknowledge that TTS/IKMS has no control over any subsequent use or disclosure of such information, and your obligations under this Agreement apply independently of any such disclosure.
  • Non-Transferability: Your right to access TTS/IKMS lab reports is personal and non-transferable. You may not sublicense, assign, or transfer your access rights to any other individual or entity.
  • Revocation of Access: TTS/IKMS may suspend or permanently revoke your access at any time for suspected misuse, unauthorized disclosure, or violation of this Agreement.
  • Independent Responsibility: You acknowledge that you are independently responsible for your handling, use, and disclosure of any information accessed through TTS/IKMS.

4. Privacy

As part of the Service registration process, you will provide certain personal information to TTS/IKMS. Your personal information will only be used in accordance with TTS/IKMS's Privacy Policy. TTS/IKMS reserves the right to inform you by email of changes or additions to the Service or of any TTS/IKMS-related products and services.

By using the Service, you consent to receive electronic communications from TTS/IKMS, including notices, updates, information related to your account and the Service, as well as communications regarding lab results, medical follow-up recommendations, and treatment options or availability when applicable.

5. Third-Party Content and Links

The Service may contain content supplied by third parties and links to internet sites maintained by third parties. TTS/IKMS does not control such content or operate such third-party sites and does not guarantee the availability of any links to third-party sites. Third-party content and links are included solely for the convenience of users and do not constitute any endorsement by TTS/IKMS. TTS/IKMS is not responsible for the accuracy or reliability of third-party information, and you assume sole responsibility for your use of such information.

6. Interaction with Other Users and User Submissions

6.1  Parts of the Service act as a venue to facilitate communications between users. TTS/IKMS is not involved in such communications and has no control over the quality, safety, or legality of dealings presented or agreed upon. You assume all risk associated with dealing with other users.

6.2  TTS/IKMS cannot confirm that each user is who they claim to be. If you have a dispute with one or more users, you release TTS/IKMS from claims, demands, and damages of every kind and nature arising out of or connected with such disputes.

6.3  You are responsible for your own communications and the consequences of their posting. TTS/IKMS does not represent or guarantee the truthfulness, accuracy, or reliability of communications posted by other users, and any reliance on such material is at your own risk.

6.4  TTS/IKMS does not pre-screen any content posted on the Service, but TTS/IKMS and its designees shall have the right (but not the obligation) in their sole discretion to refuse or remove any content that violates this Agreement or is otherwise objectionable.

7. Modifications to the Service and Agreement

TTS/IKMS reserves the right to modify or discontinue the Service at any time without notice and shall not be liable to you or any third party should TTS/IKMS exercise this right. TTS/IKMS also reserves the right to modify this Agreement at any time. You are responsible for regularly reviewing this Agreement. Continued use of the Service following any modification constitutes your acceptance of the revised terms.

8. Ownership and Licenses

8.1  All contents of the Service are the property of TTS/IKMS, participating vendors, or advertisers. The compilation of all content on the Service website is the exclusive property of TTS/IKMS. The website and its contents may not be copied, distributed, or transmitted in any way without the prior written consent of TTS/IKMS. You may not modify content, delete copyright or trademark notices, or copy the HTML code used to generate Service pages.

8.2  Any information, ideas, suggestions, or communications sent by you to TTS/IKMS through the Service becomes the exclusive property of TTS/IKMS. Subject to the Privacy Policy, TTS/IKMS is entitled to use, reproduce, disclose, and distribute any such information for any purpose without restriction or compensation to you.

8.3  Prohibited Use of Communications: You agree that any emails, text messages, phone calls, or other communications exchanged with TTS/IKMS or its representatives are confidential and proprietary to TTS/IKMS. You may not copy, record, publish, post, or otherwise disseminate such communications, in whole or in part, on any public platform (including social media, forums, or review sites) without TTS/IKMS's prior written consent. Unauthorized disclosure, reproduction, or publication of these communications constitutes a violation of this Agreement and may result in suspension or termination of your account and/or legal action.

8.4  By transmitting any messages or content to public or semipublic areas of the Service, you grant TTS/IKMS a nonexclusive, worldwide, royalty-free, perpetual, irrevocable license to use, distribute, display, and reproduce such messages and content, and to authorize use and reproduction by other Service users.

9. Termination

TTS/IKMS may immediately terminate your registration for any reason at any time. Upon termination, you will cease to use the Service, and any access to lab reports or health information through TTS/IKMS will be immediately revoked. You may terminate your registration by emailing your request to info@TalentTestingService.com or info@iknowmystatus.com.

10. Software

10.1  Any software or files made available for download from the Service ("Software") are the copyrighted work of TTS/IKMS and/or its suppliers. Use of the Software is governed by the terms of any end user license agreement ("License Agreement") that accompanies or is included with the Software. End users shall not install or use any Software accompanied by a License Agreement unless they first agree to its terms.

10.2  For any Software not accompanied by a license agreement, TTS/IKMS grants you a personal, nontransferable license to use the Software solely for viewing and using the Service in accordance with this Agreement, and for no other purpose.

10.3  You will not attempt to decipher, decompile, disassemble, or reverse engineer any software comprising or made available through the Service.

11. Disclaimer of Warranties

TTS/IKMS PROVIDES THE SERVICE AND ALL RELATED SOFTWARE AND CONTENT TO YOU "AS IS," WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT; ANY WARRANTY THAT THE SERVICE OPERATES ERROR FREE OR WITHOUT INTERRUPTION; OR ANY WARRANTY THAT INFORMATION OBTAINED THROUGH THE SERVICE IS ACCURATE OR RELIABLE. THE ENTIRE RISK ARISING OUT OF THE USE OF THE SERVICE REMAINS WITH YOU.

Any material and/or data downloaded or otherwise obtained through the Service is done at your own discretion and risk. TTS/IKMS makes no warranty regarding any goods or services purchased or obtained through the Service. No advice or information, whether oral or written, obtained by you from TTS/IKMS or through the Service shall create any warranty not expressly made herein.

TTS/IKMS does not guarantee continuous, uninterrupted, or error free access to the Service. Access may be affected by maintenance, updates, technical issues, or factors outside TTS/IKMS's control.

12. TTS/IKMS Unlimited Testing Membership

For individuals who choose to enroll in the TTS/IKMS Unlimited Testing Membership, the following conditions apply:

Enrollment requires a complete profile including a photo of a valid ID, a clear headshot image, and a completed Medical History Questionnaire (MHQ). The membership provides unlimited testing for a monthly recurring fee, which may change at any time, but members will be notified of fee changes in advance. Membership begins on the date of enrollment and automatically renews each month until canceled. Membership benefits are non transferable and may only be used by the enrolled member. Draw fees and shipping fees are not included. Test orders are to be placed online.

Supplemental, specialty, and confirmatory tests (e.g., HCV PCR NAT, FTA-ABS, Hepatitis B Viral Load) are not included in the Unlimited Testing Membership. Such services are subject to separate billing at standard rates and must be paid by the member upon ordering.

Members may have one active Custom Test Order (CT) at a time. If additional testing items are needed—such as adding swabs or Mgen—please contact TTS/IKMS staff, who may be able to add these items to your existing CT. Pending CTs remain active until the final day of your subscription cycle. If your membership is not renewed, all pending CTs will be deleted. Samples received after cancellation will be processed only if the collection date occurred before the cancellation date.

Testing is available at all U.S. & Canadian TTS/IKMS locations and Associated Draw Facilities.

If you wish to challenge a positive result within 8 days, standard testing fees apply. If a discrepancy is confirmed, retest charges will be reimbursed according to our False Positives Policy.

There are no refunds for the monthly membership fee. If you cancel, your membership benefits will continue through the end of the current billing cycle.

13. Recurring Payment Authorization & Secure Data Storage Disclosure

TTS/IKMS offers the option for individuals to securely store their credit card information through Authorize.net to streamline future test orders and payments. TTS/IKMS does not store full credit card numbers or complete payment credentials. Only the last four digits of the card and the authorized cardholder's name are retained for internal reference. All sensitive payment data is securely stored and managed by Authorize.net, a PCI certified payment gateway. For those who choose to enroll in the TTS/IKMS Unlimited Testing Membership, enrollment constitutes authorization for TTS/IKMS to charge the current monthly membership fee on a recurring basis. This fee may change, and by maintaining an active membership, you agree to any updated pricing. Monthly charges will continue until you request cancellation.

By providing your payment information, you acknowledge and agree that Authorize.net will store your card data and that TTS/IKMS is permitted to process payments—including recurring monthly membership charges, if applicable—through Authorize.net. All membership fees are non refundable, including charges processed prior to cancellation. Canceling your membership stops future billing but does not result in a refund of previously processed payments.

14. Limitation of Liability

TTS/IKMS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, OR SPECULATIVE DAMAGES ARISING FROM INTERRUPTION, SUSPENSION, OR TERMINATION OF SERVICE, OR FROM THE USE OR INABILITY TO USE THE SERVICE, OR FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, INCLUDING WITHOUT LIMITATION CONSEQUENTIAL, INCIDENTAL, AND SPECIAL DAMAGES, REGARDLESS OF WHETHER TTS/IKMS HAD ADVANCE NOTICE OF THE POSSIBILITY OF ANY SUCH DAMAGES. IN NO EVENT SHALL TTS/IKMS'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE TOTAL AMOUNT PAID BY YOU TO TTS/IKMS FOR THE SERVICE. IF NO PAYMENT WAS MADE, TTS/IKMS'S LIABILITY IS $0.

15. Indemnification

You agree to indemnify, defend, and hold harmless TTS/IKMS, their respective affiliates, officers, directors, employees, and agents from and against any and all claims, demands, damages, losses, or legal fees, including reasonable attorney's fees, arising out of or relating to: (a) your use of the Service; or (b) your breach of this Agreement or your unauthorized or improper use of any lab report or health information accessed through TTS/IKMS.

16. Compliance with Applicable Law

You agree to access and use the Service, including any lab reports, in compliance with all applicable federal, state, and local laws and regulations, including but not limited to applicable health privacy laws and U.S. law regarding the transmission and export of technical data.

17. Dispute Resolution

17.1  Informal Resolution. Before initiating any formal legal proceeding, you agree to first contact TTS/IKMS in writing and provide a reasonable description of the dispute and the relief sought. TTS/IKMS will have thirty (30) days to respond. The parties agree to attempt to resolve the dispute informally during that period.

17.2  Binding Arbitration. If the dispute cannot be resolved informally, you and TTS/IKMS agree that any dispute, claim, or controversy arising out of or relating to this Agreement or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that either party may seek equitable relief in court for infringement or misuse of intellectual property rights or for unauthorized disclosure of confidential health information.

17.3  Arbitration Opt-Out. You may opt out of the binding arbitration agreement in Section 17.2 by notifying TTS/IKMS in writing within thirty (30) days of first accepting this Agreement. Opt-out notices should be sent to info@TalentTestingService.com. If you opt out of arbitration, all disputes will be resolved in the courts specified in Section 18.4.

17.4  Class Action Waiver. You agree that any arbitration or proceeding shall be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

18. Miscellaneous

18.1  Entire Agreement. This Agreement constitutes the entire agreement between you and TTS/IKMS and supersedes all prior agreements between the parties regarding the subject matter herein. Any waiver of any provision of this Agreement will be effective only if in writing and signed by an authorized representative of TTS/IKMS.

18.2  Severability. If a court of competent jurisdiction finds any provision or portion of this Agreement to be unenforceable, the remaining provisions will continue in full force and effect.

18.3  Notices. Any notices to you or TTS/IKMS shall be made via email or regular mail. TTS/IKMS may also provide notices of changes to this Agreement by displaying notices generally on the Service. 18.4  Governing Law and Jurisdiction. This Agreement shall be governed by the laws of the State of Florida without giving effect to provisions related to choice of laws or conflict of laws. Venue and jurisdiction for any lawsuit involving this Agreement will exist exclusively in the state and federal courts in Miami-Dade County, Florida, and you hereby consent to the personal jurisdiction of such courts.
